The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 15 litres whisky was recovered from the possession of the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 24.08.2017.
Considering the facts and the circumstances of the
Patna High Court Cr.Misc. No.53750 of 2017(2) dt.09-11-2017 2/2 case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-II-cum-Special Judge, Excise, Buxar in connection with Brahmpur (Chakki O.P.) P.S. Case No. 295 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
