Petitioner, already in custody, seeks bail in connection with Ara Muffasil P.S. Case No.191 of 2018, registered under Sections 379/414 of the Indian Penal Code.

Learned counsel for the petitioner submits that the recovery of the motorcycle is not from the conscious possession of the petitioner rather it was parked in front of the house of the petitioner. The petitioner has no antecedent of committing theft of motorcycle rather two cases against him are of crop cutting and cheating and in those cases, the petitioner is on bail. Having considered the aforesaid facts and circumstances, petitioner Rohit Kumar Singh @ Barun Kumar Singh is directed to be released on bail on furnishing bail bond
