JUSTICE ARUN KUMAR ORAL ORDER 01-08-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Supplementary Beldaur P.S.Case No. 196 of 2017 registered under Sections 363 and 366A/34 of the Indian penal Code.

Accusation is that prosecutrix took lift from two accused Akshay Kumar and Avinash Kumar for coming back to home and on the way petitioner and others also reached there and they all kidnapped her and brought to Durgapur where Akshay Kumar and Avinash Kumar committed rape with her but on that place there was no presence of other accused persons. Submission is that it was a case of elopement and she eloped with Akshay Kumar and Avinash Kumar and there is no allegation of committing rape against the petitioner and he has

Having considered the aforesaid facts and circumstances, the petitioner, namely, Dilip Paswan, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Mrs. Simmi Kujur, Judicial Magistrate, 1st Class, Khagaria in connection with Supplementary Beldaur P.S. Case No. 196 of 2017.
