====================================================== CORAM: HONOURABLE MR. JUSTICE SOURENDRA PANDEY ORAL ORDER 09-05-2025 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State.
2. The petitioner seeks regular bail in connection with Panapur P.S. Case No.213 of 2024, registered for the offences punishable under Sections 115, 118(1), 117, 109, 103(1), 352 and 3(5) of Bhartiya Nyay Sanhita. The petitioner has clean antecedent.
3. The allegation upon the petitioner is that he along with other accused persons have brutally assaulted the informant and her husband by means of deadly weapons including Lathi and Iron rod etc. resulting in injury to the informant's husband, who during the course of treatment died.
4. The learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.19559 of 2025(2) dt.09-05-2025 2/3 petitioner is innocent and has falsely been implicated in this case due to the land dispute between the parties, who are agnates. The learned counsel further submits that the allegations are general and omnibus upon all the named accused persons and during the investigation, nothing specific has come out against the petitioner. Learned counsel further submits that similarly situated co-accused, namely Brij Kishore Raut has already been granted bail by a Co-ordinate Bench of this Court vide order dated 19.03.2025, passed in Criminal Misc. No. 16849 of 2025. It has lastly been submitted that the charges has been framed and he is in custody since 26.10.2024.
5. Learned Additional Public Prosecutor for the State as well as the informant opposes the prayer for bail.

Considering the aforesaid submissions made by the respective parties and taking into account the fact that there is general and omnibus allegation upon all the accused persons and similarly situated co-accused person has already been granted bail, I am inclined to grant the petitioner privilege of regular bail.
7. Accordingly, the prayer for bail is allowed.
8. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Ten thousand) with
Patna High Court CR. MISC. No.19559 of 2025(2) dt.09-05-2025 3/3 two sureties of the like amount each to the satisfaction of the court of learned A.D.J. XI, Saran at Chapra, in connection with Panapur P.S. Case No. 213 of 2024.
9. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
