JUSTICE AKHILESH CHANDRA ORAL ORDER 24-12-2013 This application with respect to petitioner no. 3, namely, Indal Ram, has already stands dismissed being infructuous vide order dated 23.07.2013.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State, who is armed with carbon/xerox copy of the case diary.

The two female petitioner nos. 1 & 2, who are apprehending their arrest in connection with a case registered for the offence punishable under Sections 302 and 201/34 of the Indian Penal Code, are named accused in this case on recovery of dead-body of informant's husband from a well on mere suspicion due to dispute between the kids of the family more than a week ago.

Submission is of false implication on unfounded suspicion and there is absolutely nothing more than that against these two petitioners, who carry no criminal antecedent.

If it is so, considering the facts and circumstances of the case, in the event of their arrest or surrender before the court below within four weeks, let the abovenamed petitioner nos. 1 & 2 be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand only) each with two

Patna High Court Cr.Misc. No.23444 of 2013 (4) dt.24-12-2013 sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with Durgawati P.S. Case No. 167 of 2012, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure with additional condition to remain physically present before the court below on each and every date at least for two years or till disposal of the case, whichever is earlier and in case of failure on two consecutive dates without giving any reasonable explanation, the liberty granted shall be deemed to be cancelled.
