1. Heard learned counsel for the petitioner, learned APP for the State and the learned counsel appearing on behalf of the informant.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 80(2), 3(5) B.N.S.
3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that his daughter was married to Krishna Yadav on 15.07.224 and after marriage, the accused persons including the petitioner behaved in a proper manner for sometimes, but thereafter, her husband and in-laws started demanding Rs.50,000/- cash and for non-fulfilment of the
Patna High Court CR. MISC. No.19501 of 2025(2) dt.23-04-2025 2/3 demand, the victim was assaulted. Further, the victim also used to inform the informant about the torture being meted out to her. It is further alleged that on 13.10.2024 at about 9.15 A.M., the victim called her friend Rani and disclosed that her husband and in-laws have assaulted her and told her to talk to her mother and asked her to bring Rs.50,000/-. Further, after half an hour, her son in-law called Rani and asked her to disclose that the victim has died.
4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case. It is further submitted that petitioner is uncle of Krishna Yadav and there is no specific allegation of demand of dowry and torture against him. It is further submitted that whenever any occurrence of the nature as alleged takes place, the entire family members including relatives are implicated in a mechanical manner. It is further submitted that the husband of the deceased is in custody.
5. Learned A.P.P. opposes the anticipatory bail application.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below
Patna High Court CR. MISC. No.19501 of 2025(2) dt.23-04-2025 3/3 within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Koransarai P. S. Case No.92 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
7. The application stands allowed.
