The present application has been filed for modification of order dated 12.01.2023 passed in Cr. Misc. No. 71016 of 2022.

Learned counsel for the petitioner submits that the petitioner is poor person and he is unable to deposit Rs. 5,00,000/- (Rupees Five Lakh) in the PM Cares Fund, as mentioned in paragraph No. 5 of the order dated 12.01.2023. Perused the order dated 12.01.2023, the modification application and heard learned counsel for the petitioner. The petitioner was granted bail on 12.01.2023, on the submission of learned counsel for the petitioner that the petitioner is agreed to

Patna High Court CR. MISC. No.23533 of 2023(2) dt.12-04-2023 2/2 deposit the aforesaid amount and now he submits that he is unable to do so. The offer was offered by learned counsel for the petitioner himself.

In that view of the matter, I am not inclined to modify the earlier order dated 12.01.2023.

Accordingly, this modification application is dismissed.

However, if the petitioner surrenders before the learned Court below within a period of six weeks from today and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order.
