JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending her arrest in a case instituted under Sections 363, 366A and 379/34 of the Indian Penal Code.

The informant has alleged that his daughter, Mausham Kumari, aged 16 years has been abducted by the villagers, namely, Sajjan Tanti s/o Vivek Tanti and Tetri Devi wife of Vivek Tanti, Dhirkan Devi wife of Dinesh Tanti and Panchi Devi w/o Ramchandar Tanti jointly. They have also taken away cash of Rs. 15,000/- and ornaments by enticing her.

It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent. The petitioner is aged 73 years old lady. She is the grand mother of co-accused Sanjay

Patna High Court Cr.Misc. No.27865 of 2015 (3) dt.29-09-2015 2/2 Kumar. From perusal of Annexures 2 and 3 it appears that the said Sanjay Kumar has already married the victim and they are living together. From perusal of Annexure 2 to the supplementary affidavit it appears that the victim is under family way. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Bakhri P.S.Case No.324 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
