The petitioner is in custody in connection with GRPS Case No.103 of 2017 registered for an offence under Sections 328 and 379 of the IPC.
The case has been registered for an offence under Sections 328/379 of the IPC on the fardbeyan of the train passengers who was allegedly intoxicated.
The learned counsel for the petitioner submits that the petitioner was apprehended by police party in suspicion in GRP Case No.121 of 2017 in which the police allegedly recorded confession of this petitioner and thereafter he has been remanded in this case. There is nothing against this petitioner except
Patna High Court Cr.Misc. No.60498 of 2017 (2) dt.19-12-2017 2/2 confession before police. The petitioner is in custody since 18.08.2017 and except the present case and aforesaid GRP Case No.121 of 2017 nothing is against the petitioner. The learned APP opposed the submission.
Considering the aforesaid facts and circumstance of the case, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM, Railway, Bhagalpur in connection with GRPS Case No.103 of 2017.
