2. In this present case, the petitioner seeks bail in connection with Sheikhopur Sarai P.S. Case No. 14 of 2025 registered for the offences under Sections 316(2), 319(2), 318(4), 338, 336(3), 340(2), 61(2) and 3(5) of the B.N.S and Sections 66(c) and 66(d) of the I.T. Act.
3. As per prosecution case, police received information about 10-12 persons indulging in cyber crime of online cheating. A raid was conducted and petitioner and other six other co-accused persons were apprehended and a number of co-accused fled away from the spot. From this petitioner, recovery of three mobile phones were made. Further recovery of mobile phones were made from other co-accused persons. Police came to know that giving inducement of

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing incriminating has been recovered from the person or possession of this petitioner. Mobile phone recovered from the petitioner is his own phone. Merely on suspicion the petitioner has been arrested in this case. Petitioner has no concern with co-accused persons. Petitioner is in custody since 25.01.2025 and charge-sheet has been submitted. Petitioner is having antecedent of two more cases and he is on bail in both the cases. Five other co-accused persons have been granted bail by a Co-ordinate Bench of this Court vide order dated 21.04.2025 passed in Cr. Misc. No. 17925 of 2025, Cr. Misc. No. 18470 of 2025 and Cr. Misc. No. 18482 of 2025, order dated 23.04.2025 in Cr. Misc. No. 18673 of 2025 and order dated 29.04.2025 in Cr. Misc. No. 19591 of 2025.
5. Learned A.P.P. opposes the submission made on behalf of the petitioner.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the vague nature of allegation against the petitioner without any substantive material and also considering the clean antecedent of

No.17134 of 2025(3) dt.15-05-2025 3/3 the petitioner along with his period of custody and submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sheikhpura/concerned court in connection with Sheikhopur Sarai P.S. Case No. 14 of 2025, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
