JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-09-2020 Heard learned counsel appearing for petitioners as well as learned Additional Public Prosecutor Sri Ajay Kumar No.2 appearing for State through video conferencing.

At the very outset, learned counsel appearing for petitioners submit that by filing supplementary affidavit he has already removed defect no.1 and 2.

Petitioners are in custody in connection with Paraiya P.S. Case No.139/2019 registered under Section 302/34 of the IPC. The wife of petitioner no.1, namely, Shanti Devi (deceased) was in love with deceased Kundan @ Taini and dead body of wife of petitioner no.1 and above stated Kundan Kumar @ Taini were found hanging with tree and thereafter informant lodged the present case.

However, the postmortem reports of both the deceased persons goes to show that no injury except one ligature mark in 'V' shaped was found on the person of both the deceased persons.

Learned counsel of petitioners submit that petitioner no.2 is father-in-law whereas petitioner no.3 is Debar of deceased Shanti Devi and they do not have any concern with the affairs of petitioner no.1 and so far as petitioner no.1 is concerned, except suspicion there is nothing against him.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let petitioners be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Paraiya P.S. Case No.139 of 2019.
