Petitioner seeks regular bail in connection with Ekangarsarai PS Case No. 18/2022 registered for the offence punishable under Section 30(a) of Bihar Prohibition & Excise (Amendment) Act 2018.

4.125 litres of illicit liquor has been recovered from the motorcycle of one Karu @ Pinku Kumar who disclosed that he has brought the liquor from one Ajeet Kumar who disclosed the name of one Mukesh Kumar from whose house 557.25 litres of illicit liquor has been recovered.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of statement of co-accused, Karu @ Pinku Kumar who along with Ajeet Kumar have already been granted regular bail by a Bench of this Court vide Cr. Misc. No. 10901/2022. Other two accused

Patna High Court CR. MISC. No.18398 of 2022(2) dt.25-05-2022 2/2 persons, namely, Haresh Kumar and Ramshu Kumar have been granted anticipatory bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 17857/2022. Learned counsel further submits that no illicit liquor has been recovered from the conscious possession of the petitioner. The petitioner is in custody since 02.02.2022.

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that similarly situated accused persons have been granted regular as well as anticipatory bail by the Benches of this Court, no illicit liquor has been recovered from the conscious possession of the petitioner, he is in custody since 02.02.2022, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Court No.1-Biharsharif, Nalanda in connection with Ekangarsarai PS Case No. 18/2022.
