The Petitioner seeks bail in Bheja P.S. Case No. 35 of 2017 corresponding to G.R. No. 971 of 2017 registered for the offence punishable under Sections 302, 201/34 of the Indian Penal Code.

Informant is the brother of the deceased who in his written report has submitted that on 23.06.2017 at about 7:00 am, he received the information that the dead body of his brother was lying in Gandhahara Bad Bahera Char. After receiving the said information, he went there and identified the dead body of his brother. It has been alleged that on account of land dispute Baidhnath Thakur @ Chhedi Thakur and Pramod

Patna High Court Cr.Misc. No.59137 of 2017(2) dt.12-01-2018 2/2 Kumar Jha, have conspired to kill his brother. The petitioner is not named in the FIR and his name has only surfaced in this case on the basis of the statement made by one Sharda Devi one of the co-accused who had already been granted bail vide order dated 09.11.2017 in Criminal Miscellaneous No. 53530 of 2017. It has been further submitted that other similarly co-accused Baidyanath Thakur @ Chhedi Thakur had also been granted bail by order dated 21.09.2017 in Criminal Miscellaneous No. 36611 of 2017. The petitioner has got no criminal antecedent and is in custody since, 28.06.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., IIIrd, Jhanjharpur, Madhubani in connection with Bheja P.S. Case No. 35 of 2017 corresponding to G.R. No. 971 of 2017.
