The petitioner seeks bail in connection with Alamnagar (Ratwara) P.S. Case No. 123 of 2011 registered for the offences punishable under Sections 324, 307/34 of the I.P.C. and Section 27 of the Arms Act.
The allegation is regarding the accused persons including the petitioner herein having assaulted the husband of the informant and it is submitted that one of the accused persons had fired gun shot resulting in pellet injury in the wrist. The learned counsel for the petitioner has submitted that there is no injury report on the record of the present case and in fact the injured had not got examined himself which leads to the conclusion that the allegation is false and concocted. No.32689 of 2018 (3) dt.23-07-2018 2/2 submitted that the petitioner is languishing in custody since 10.01.2018 and similarly situated co-accused person has already been granted bail by a coordinate Bench of this Court by order dated 02.12.2016 passed in Criminal Misc. No. 46186 of 2016. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Uda-Kishunganj, Madhepura in connection with Alamnagar (Ratwara) P.S.
