Petitioners apprehend their arrest in a case registered for the offences punishable under Section and other allied sections of the Indian Penal Code.
Prosecution's case in short is that the petitioners and other co-accused persons went to the door of the informant, abused her and assaulted her and her family members with lathi, danda, iron rid, tengari etc.
Learned counsel appearing for the petitioners submits that the petitioners have falsely been implicated in this case. There is subsisting land dispute between them as the parties are co-sharer. There is a case and counter case between the parties. Specific allegation is against other co-accused person and only general and omnibus allegation have been alleged against the
Patna High Court CR. MISC. No.16148 of 2020(3) dt.03-09-2020 2/2 petitioners. Petitioners have got no criminal antecedent. Considering the facts of the case, let the petitioners named above, in the event of surrender before the Court below within six weeks from the date of receipt of this order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Biraul at Darbhanga in Ghanshyampur Police Station Case No. 56/2019, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
