The petitioner seeks regular bail in connection with Industrial Area P.S. Case No. 131 of 2017, registered for the offence punishable under Sections 302, 120(B), 34 of the Indian Penal Code and Section 27 of the Arms Act.

The case of the prosecution is that the daughter of the informant was shot dead while travelling in a tempo and F.I.R. named accused persons are suspected to have killed her. The learned counsel for the petitioner submits that the petitioner is a non F.I.R. named accused person and he has been falsely implicated in the present case on account of confessional statement made by one Md. Riyaz, who has already been granted bail by this Court by an order dated

Patna High Court Cr.Misc. No.32746 of 2018(3) dt.23-07-2018 2/2 20.04.2018 passed in Criminal Miscellaneous No. 21980 of 2018. The petitioner is stated to be languishing in custody since 12.12.2017.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional District Judge, Bhagalpur in connection with Industrial Area P.S.
