JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-07-2015 Heard the petitioner in person and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 447,353,504 and 506/34 of the Indian Penal Code.

The prosecution case as per written report of the Executive Engineer, Central Building Division, Patna, is to the effect that Quarter No. 31 situated at Harding Road, Patna, which was earlier occupied by the then Minister, Land Reforms and Revenue Department, was vacated on 15.1.2014. The officials of PWD (Building) went to take possession thereof when the petitioner is alleged to have abused them.

It is submitted by the learned counsel for the petitioner that the petitioner is claiming the land adjacent to Quarter no. 31

Patna High Court Cr.Misc. No.30685 of 2015 (2) dt.30-07-2015 2/2 and 32 as a decree has been passed in favour of the petitioner with regard to the said land. When the petitioner was obstructed in fencing his land in pursuance to the decree passed in his favour, the petitioner came to this court in C.W.J.C. No. 777 of 2013 and subsequently in MJC No. 3378 of 2013 when orders in favour of the petitioner were passed.

Considering the nature of accusation in the background of civil nature of dispute when a decree has been passed in T.S. No. 36 of 1994 in favour of the petitioner, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, Patna in connection with Sachiwalaya P.S. Case No.13 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
