The petitioner seeks regular bail in connection with Kisanpur P.S. Case No. 241 of 2021 lodged under Sections 147, 148, 149, 341, 323, 324, 326, 307, 379, 504, 506 of Indian Penal Code read with Section 25 (1-b)a, 26, 37, 27 of Arms Act, later on Section 302 of Indian Penal Code has been added on 02.12.2021.
The present F.I.R. has been lodged against 18 named persons in which Umesh Yadav is alleged to have fired upon Shivchandra Yadav. There is no specific allegation made against present petitioner in the F.I.R. save and except that a general and omnibus allegation, to assault upon him.
Learned counsel for the petitioner submits that the date of occurrence is 26.11.2021 in the evening. The present
Patna High Court CR. MISC. No.17976 of 2022(2) dt.13-07-2022 2/2 F.I.R. has been lodged by Pramod Kumar Yadav in which petitioner is accused no.15. He further submits that for the occurrence of same day and time wife of present petitioner has also filed a criminal case bearing Kisanpur P.S. Case No. 249 of 2021. Injury took place from both the sides. Actual dispute between both the set of parties are relating to voting of Panchayat Election. Learned counsel for the petitioner further submits that petitioner is in custody since 20.12.2021 and charge sheet has already been filed in this case. Petitioner having no criminal antecedent.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Kisanpur P.S. Case No. 241 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
