The petitioners seek anticipatory bail in connection with Complaint Case No. 1318C of 2016, registered for offences
Patna High Court Cr.Misc. No.37553 of 2018 (3) dt.23-07-2018 2/3 punishable under Sections 147, 149, 380 and 354 (B) of the Indian Penal Code.
Allegation against the petitioners is that they have assaulted the complainant with foot and slap and pulled her dupatta.
Submission of the learned counsel for the petitioners is that there is vague and general allegation against the petitioner and dispute arose due to passage and only to save skin, the present case has been filed by the complainant and petitioner Nos. 3 and 4 are Uncle and petitioner Nos.1 and 2 are brothers. . Learned A.P.P. as well as learned counsel for the informant opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each in connection with Complaint Case No. 1318C of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate, Jamui, subject to the conditions laid down under Section 438 ( 2) Cr.P.C. with other that bailors should be local
