Petitioner apprehends his arrest in Abadpur P.S. case no. 50 of 2018 instituted for the offence under Section(s) 341,323,325,307,504 and 379/34 of the Indian Penal Code. It is submitted on behalf of the petitioner that there is general and omnibus allegation against this petitioner in the written report. It has further been submitted that there is counter case filed by the mother of petitioner vide Abadpur P.S. case no. 54 of 2018. Both parties are agnates. There are several litigation pending between them since long.

Learned counsel for the State has opposed the prayer and submitted that restatement of the informant is available at para 6 of the case diary wherein he has levelled specific allegation

Patna High Court Cr.Misc. No.39052 of 2018(3) dt.23-07-2018 2/2 against this petitioner of assaulting the informant on head with iron rod. The injury report of the informant has been mentioned at para 15 of the case diary wherein the doctor has opined the injury on skull bone was found to be grievous in nature. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the Court below and make prayer for regular bail which shall be considered and disposed of, if possible on the same day, on its own merit in accordance with law without being prejudiced by the present order.
