Petitioner seeks bail in connection Suppi P.S. Case no. 268 of 2019 registered for the offence punishable under sections 414, 272, 273/34 of the Indian Penal Code read with section 30(a) of Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 22.01.2021 and charge sheet has been submitted. Allegation of recovery of 2700 liter of Nepali Saufi. Learned counsel for the petitioner next submits that apprehended accused Rajiv Mandal and Sanjiv Kumar disclosed that they were working for the petitioner as liner and name of the petitioner transpired in the confessional statement. He further submits that petitioner is person with clean antecedent. It

Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is in jail custody since 22.01.2021 and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ADJ II-cum- Special Judge, Excise Act, Sitamarhi in Suppi P.S. Case no. 268 of 2019.
