2 This application has been filed on behalf of the petitioners for grant of anticipatory bail, who are apprehending their arrest in connection with Baheri PS Case No 313 of 2024 dated 10.09.2024 registered for the offence punishable under Sections 126 (2), 115 (2), 109, 303 (2), 352, 351 (2), 118 (1), 3

(5) of the BNS.

3 The allegation against the petitioners in the FIR is that they entered in the room and broke the lock of the almirah and took away some cash.

4 The learned counsel for the petitioners submits that

No.18276 of 2026(2) dt.15-07-2026 2/3 the petitioners and the informant are next door neighbours and even if the allegation would be seen on its face value, there is no allegation of assault against the petitioners. The act, which has been attributed against the petitioners, is cosmetic for the reason that they entered in the room and broke the lock of almirah and took away some cash. He has further drawn attention of this Court towards Annexure 2, i e, the counter case and the further submission is that the injuries sustained by the informant side, in the opinion of the doctor, are simple in nature. 5 The learned counsel for the State vehemently opposed the prayer for bail.

6 Having considered the rival submissions and in the backdrop that there is no allegation of assault against the petitioners and petitioner No 1 is a man of clean antecedent, as far as petitioner No 2 is concerned, he has got two criminal antecedents, in one case, he is on bail and in another case, he was given the benefit of Probation of Offenders Act, I am inclined to grant anticipatory bail to the petitioners. 7 Let the petitioners above named, in the event of their arrest/surrender within a period of four weeks from today, be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like
