The petitioners seek regular bail in connection with Adapur P.S. Case No.61 of 2012 registered for the offences punishable under Sections 302, 201, 120(B)/34 of the Indian Penal Code.
The petitioners before this court are mother-in-law, wife and brother-in-law of the deceased. The deceased was married with petitioner no.2. After recovery of dead body of informant's son, it was suspected that the petitioners might have committed murder of the deceased. It is alleged that the petitioner no.2 (wife) was having illicit relationship with several persons.
Patna High Court Cr.Misc. No.37356 of 2018 (3) dt.23-07-2018 It has been submitted that the petitioners had no motive to commit murder of deceased. The dead body was recovered from fire wood house of father-in-law of the deceased. The father-in-law of deceased has been allowed bail by one of the coordinate bench of this court in Cr.Misc.No.1241 of 2014 on 04.03.2014. The case of the petitioners stands on similar footing. Petitioner nos.1 and 2 are in custody since 09.02.2018 and petitioner no.3 is in custody since 15.12.2017 and so they deserve to be enlarged on bail.
The learned A.P.P. for the State opposed the submission.
Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of like amount each to the satisfaction of the learned Additional Sessions JudgeIV, Motihari (East Champaran) in connection with Adapur P.S. Case No.61 of 2012 corresponding to Sessions Trial No.259 of 2018.
