Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under sections 399, 402, 414 of the Indian Penal Code and section 25(1-B)(a), 26, 35 of the Arms Act and sections 8/20(b)(ii)(3) of the NDPS Act. After seeing the police party, 4-5 miscreants started to flee away but two miscreants were apprehended by the police and 3 miscreants succeeded to flee away. The apprehended person disclosed his name as Aman Shukla.

The name of the petitioner has sprung up in the confessional statement of co-accused Aman Shukla. The petitioner has no criminal antecedent as stated at para 3 of the bail petition. The petitioner is in custody since 29.01.2022. Learned A.P.P. for the State has opposed the bail petition of the petitioner by submitting that the Glamour motorcycle was recovered from the possession of the petitioner. Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Spl. Judge, Muzaffarpur, in connection with Gaighat P.S. Case No. 46 of 2022. The application stands allowed.
