DR. RABINDRA KUMAR ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 09-11-2017 I have heard learned counsel for the petitioners and the State.
The petitioners seek bail in a case registered for offences punishable under sections 272 and 273 of the Indian Penal Code and section 47 (a) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 200 litres of semi prepared country-made liquor and equipment for preparation of wine were recovered from bank of river. It is further contended that petitioners were implicated only on the basis of suspicion that they are owners of the said illegal liquor and equipment. Petitioners claim that they are having clean antecedents and are in custody since 6.9.2017.
Patna High Court Cr.Misc. No.51991 of 2017(2) dt.09-11-2017 2/2 Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on bail on their furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, East Champaran at Motihari in connection with Pakridayal P.S. Case No. 06/15. If the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
