Petitioner seeks bail in Baniyapur P.S.Case No.182 of 2018 registered for the offences under Sections 341, 323, 302, 379, 504, 506 and 34 of the Arms Act.
Allegation against the petitioner is of order giver and other accused persons assaulted the father of the informant with lathi, danda and they put their leg on the deceased. Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and he is in custody since 21.06.2018. Similarly situated co-accused Nitesh Kumar Singh has been granted bail by coordinate Bench of this Court vide order dated 10.08.2018 passed in Cr.Misc.No.49254 of 2018. Heard learned A.P.P. also who opposed the prayer for
Patna High Court Cr.Misc. No.46379 of 2018 (2) dt.13-09-2018 2/2 bail.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M. - 11th Saran at Chapra, in Baniyapur P.S. Case No.182 of 2018 subject to the conditions that (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in the disposal of the trial and make himself available as and when required by the court, otherwise, his bond shall be cancelled.
