This application is filed for grant of regular bail in connection with Spl. Case No. 11 of 2020 arising out of R.C. Case No. 10(A) of 2018 registered under section 34/120() read with section 409, 420, 467, 468, 471 of Indian Penal Code and Section 13(2) read with Section 13(1)(C) and 13(1)(d) of prevention of Corruption Act, 1988.
It is submitted by the learned counsel for the petitioner that the petitioner was working in Bank of Baroda as Branch Manager. He has cooperated during investigation. He was not arrested by Central Bureau of Investigation during investigation but after the submission of charge-sheet when he appeared he was remanded and arrested in connection with
Patna High Court CR. MISC. No.23941 of 2023(2) dt.18-05-2023 2/2 another case of similar nature and he is in jail since 06.12.2022 and he also relied upon the law laid down in the Case of Satyendra Kumar Antil Vs. Central Bureau of Investigation (2022) 10 SCC 51.
Learned Senior counsel for the C.B.I has vehemently opposed the prayer for bail after taking this Court to the materials available against the petitioner in the charg-sheet in Paragraph 16.
In view of the law laid down in the Case of Satyendra Kumar Antil Vs. Central Bureau of Investigation (2022) 10 SCC 51, this application is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, CBI-II, Patna in connection with Spl. Case No. 11 of 2020 arising out of R.C. Case No. 10(A) of 2018. The petitioner is directed to cooperate in the trial. If the petitioner does not cooperate in the trial, the Court below is at liberty to cancel the bail bonds of the petitioner. (Sandeep Kumar, J) Sunnykr/- U T
