2. The petitioner seeks bail in connection with Bhawanipur P.S. Case No. 228 of 2025 instituted for the offences under Section 87 of the Bharatiya Nyaya Sanhita.

3. The allegation is that the daughter of the informant was kidnapped by the petitioner and he had sold the lady in Rajasthan. His daughter informed him about the same. She informed that she was with one Jitendra Joshi at Chitaur. Her statement was recorded and she levelled allegation that Brajesh Sah (petitioner) gave her something to eat. Thereafter, she

Patna High Court CR. MISC. No.19028 of 2026(3) dt.04-05-2026 2/3 became unconscious. Brajesh Sah forced her to marry a person named Jitendra Joshi who took her to Rajasthan. She stated that Jitendra Joshi used to keep her properly.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner is in custody since 16.11.2025 and has got no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. The lady seems to have made clearl allegation of kidnapping against the petitioner. However, her statement would show that the person Jitendra Kumar to whom she was married was keeping her properly. The petitioner bears no criminal antecedent and he is in custody since 16.11.2025, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.F.C. Purnea/concerned Court in connection with Bhawanipur P.S. Case No. 228 of 2025.
