The petitioner apprehends his arrest in connection with Chhatapur P.S. Case no. 263 of 2017, registered under Sections 302, 120-B/34 and Section 3/4 of the Dowry Prohibition Act. The allegation of informant Md. Saiad Ali is that he performed marriage of his daughter with Md. Atikurrahman, son of Hajikalumudrahman, Resident of Indrapur, P.S. Chhatapur, DistrictSupaul in the year 2007 according to Mulsim customs and due to their wedlock two children born, but she was being misbehaved by her husband and other in-laws. On 17.07.2017 husband of his daughter and in-laws caused grievous injuries to his daughter. On receiving information, the informant reached at village Indrapur and saw her daughter unconscious and on the instruction of the petitioner his daughter was rushed for treatment, she died regarding which
Patna High Court Cr.Misc. No.54635 of 2017 (2) dt.16-11-2017 2/2 information was also given by the petitioner. Learned counsel for the petitioner submits that admittedly, the petitioner is the brother-in-law of the husband of the deceased and he used to reside in his village situated in Alwar, but with ulterior motive, he has also been implicated in this case. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-IV, Supaul in connection with Chhatapur P.S. Case No. 263 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
