JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody since 19.03.2018 in connection with Murliganj P.S. Case No. 80 of 2018 for the offence under Sections 341, 323, 506, 307/34 of the Indian Penal Code and 27 of Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 19.03.2018. He further submits that the allegation against the petitioner is that he was a member of the mob, who shot the father of informant. Learned counsel appearing on behalf of the informant oppose the bail prayer of the petitioner however, he admits that there is no overt act against this petitioner.

Considering the fact that the petitioner is in custody

Patna High Court Cr.Misc. No.35716 of 2018(3) dt.23-07-2018 2/2 since 19.03.2018, let the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura, in connection with Murliganj P.S. Case No. 80 of 2018.
