JUSTICE RAJESH KUMAR VERMA ORAL ORDER 29-01-2022 Heard learned counsel for the petitioner and the learned A.P.P. for the State in virtual Court proceeding. The petitioner seeks bail in connection with Mohammadpur P.S.Case No.143 of 2019 registered for the offence under Sections 363,366A and 34 of the Indian Penal Code.

The prosecution case, in short, is that on 31.07.2019 at about 2.00 P.M. while the daughter of informant, namely, Anjali Kumari, aged about 16 years, in the way to poultry farm of informant, petitioner in association with co-accused persons kidnapped her by enticing her for the purpose of marriage. It is also stated therein the written report that when informant contacted with the petitioner on his mobile, he disclosed he brought his daughter for the purpose of marriage.

Patna High Court CR. MISC. No.27977 of 2021(3) dt.29-01-2022 2/2 Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent. He has falsely been implicated in the present case. He further submits that this is a case of love affairs between the informant and the petitioner. The present case is false implication of the petitioner. Learned A.P.P. for the State, on the basis of the material available on the record, case diary and statement of the victim girl under Section 164 Cr.P.C., submits that the 164 Cr.P.C. statement of the victim girl confirms the allegation as alleged in the FIR.

Considering the aforesaid fact, I am not inclined to enlarge the petitioner on bail in connection with Mohammadpur P.S.Case No.143 of 2019 pending in the court of learned Additional Chief Judicial Magistrate-I, Gopalganj. Prayer is refused.
