The petitioner seeks regular bail in connection with Gandhi Maidan P.S. Case No. 73 of 2018, registered for the offence punishable under Sections 395 and 397 of the Indian Penal Code.

The allegation in the present case is regarding unknown accused persons having apprehended the brother of the informant and having shot him resulting in grievous injury to him, whereafter, it is said that unknown miscreants had looted various articles from the brother of the informant. The learned counsel for the petitioner submits that the petitioner has neither been named in the F.I.R. nor any recovery has been made from the petitioner nor T.I.P. has been held. It is further

Patna High Court Cr.Misc. No.33598 of 2018(3) dt.23-07-2018 2/2 submitted that the petitioner is having a clean antecedent and he is languishing since 20.03.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge VI-cum-Additional Chief Judicial Magistrate, Patna in connection with Gandhi Maidan P.S. Case No. 73 of 2018.
