The petitioners apprehend their arrest in Saharsa(Sonbarsa Kachahri) P.S. Case No.1213 of 2018 registered under Sections 147, 149, 342, 323, 324, 308, 354, 384, 379, 504, 506, 325 of the Indian Penal Code. The informant alleged that the petitioners and others surrounded them and assaulted him and took away different articles from the possession of the informant and his family members.

The learned counsel for the petitioners submits that the present case was lodged on 08.11.2018. The informant made false allegation that the petitioners assaulted the informant. In

Patna High Court CR. MISC. No.18828 of 2019(2) dt.28-03-2019 2/2 fact, the informant solemnised love marriage with Sapna Kumari, daughter of petitioner No.1 but later on, informant deserted her and drove her out from the house after assaulting Sapna Kumari. Sapna Kumari filed Complaint Case No.1285 of 2018 on 01.11.2018. In order to save his own skin, the informant lodged the present case against his father-in-law and his family members.

Taking into consideration the facts aforesaid and nature of allegation made against the petitioners and the fact that informant is son-in-law of petitioner No.1, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Baijnath Ram, learned Chief Judicial Magistrate, Saharsa in connection with Saharsa(Sonbarsa Kachahri) P.S. Case No.1213 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
