JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-12-2017 Heard learned counsels for the petitioner and State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 467, 468, 471, 406, 420and 120B of the IPC.
The prosecution case is that on 03.07.2017, one Gunsagar Rishideo came to the informant who is the Circle Inspector and on the basis of forged Purcha, issued in Case No. 59 of 1998-99, requested for issuance of rent receipt. On enquiry, Gunsagar Rishideo conveyed that this petitioner gave him the forged purcha after receiving Rs. 7,000/-.
It is submitted by learned counsel for the petitioner that the petitioner is not the employee of Circle Office, but since the father of the petitioner, Harilal Mandal is a witness in Complaint Case No. 459C of 2017, filed with accusation under Sections
Patna High Court Cr.Misc. No.59480 of 2017(2) dt.12-12-2017 2/2 323, 341,354,420, 406, 120B, 467, 468 and 471 of the IPC against the present informant, hence the petitioner has been roped in the present case. A statement has been made in paragraph no.3 of the petition that the petitioner is accused in two other cases also, but it is orally submitted that the petitioner is on bail in other cases.
Considering the thrust of accusation against Gunsagar Rishideo, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned ACJM, Araria in connection with Palasi P.S. Case No. 169 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
