JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 22-04-2019 The petitioner is aggrieved by the appointment of private respondent No. 8 on the post of Anganbari Sevika on the ground that though she has been adjudged the most suitable candidate and has been placed at serial No. 1 in the merit list but she does not have the requisite qualification nor does she hail from the area from where the candidates have to be selected. A complaint also has been made by the petitioner before the District Programme Officer, Nalanda

Patna High Court CWJC No.6246 of 2019 dt.22-04-2019 2/2 (respondent No. 5) in the month of July, 2018 but till date, no action has been taken on the aforesaid complaint.

2. In the aforesaid circumstances, the petitioner is directed to file a fresh complaint/representation before the District Programme Officer, Nalanda (respondent No. 5) within a period of four weeks from today, who, on receipt of such complaint/representation, shall dispose it off by a reasoned order, after affording hearing to all the necessary parties i.e. the petitioner and the private respondent No. 8 and other stakeholders within a further period of eight weeks thereafter.

3. Should the petitioner feel aggrieved by the order of the District Programme Officer, Nalanda, it would be open for her to approach the District Magistrate, Nalanda for the needful.

4. With the aforesaid observation/direction, the writ petition is disposed off.
