JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-02-2023 The present writ petition has been filed seeking the following reliefs:- "(i) For issuance of an appropriate writ, order, direction to quash the order dated 22.01.2013 passed in Land Dispute Case No. 154/2012-13 by learned D.C.L.R., Benipatti and for restraining the official respondents from taking any further action in pursuance of order aforesaid for handing over the possession of lands in dispute in favour of respondent no.

Patna High Court CWJC No.15081 of 2014(2) dt.28-02-2023 2/3 8.

(ii) For issuance of an appropriate writ, order, direction to quash the Notice No. 64/N dated 30.07.2014 issued under the seal and signature of the Circle Officer, Benipatti by which the petitioner has been directed to hand over the possession of an area of 10 Dhurs 12 Kanwa of Plot No. 545 and an area of 5 Dhurs 8 Kanwa of Plot No.

549 of Mauza Araji Jagat in favour of Respondent No. 8 on or before 13.08.2014 otherwise legal action would be taken against petitioner.

(iii) For issuance of an appropriate writ, order, direction to the respondents that order dated 07.09.2013 and 29.01.2014 passed in Title Suit No. 320/13 by learned SubJudge Ist, Madhubani has binding effect between the parties including the respondents as the subject-matter of this application is also the part of the Title Suit No. 320/13."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of

Patna High Court CWJC No.15081 of 2014(2) dt.28-02-2023 3/3 the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty so sought is granted.

The writ petition stands disposed off as not pressed.
