====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 16-04-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. In the present case, the petitioner seeks bail in connection with Magadh University P.S. Case No. 67 of 2020, registered for the offences under Sections 304(B), 201/34 of the Indian Penal Code.

3. As per the prosecution case, on non-fulfillment of dowry demand, the daughter of the informant was killed by the petitioner and other co-accused persons. The petitioner is stated to be the father-in-law of the deceased.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. There is no eye witness to the alleged occurrence and it is a fact that the deceased never

Learned counsel further submits that there is general and omnibus allegation against the petitioner. No overt act has been attributed to this petitioner who never tortured the deceased. The deceased and her husband were living separately and the petitioner has no concern with their family affair. Charges have been framed on 06.05.2023 and none of the prosecution witnesses has been examined till date. The husband of the deceased has been granted bail by the learned subordinate court. Learned counsel further submits that the petitioner is in custody since 17.05.2022 and he has no criminal antecedent.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner. Learned A.P.P. submits that the petitioner and other co-accused persons have been specifically named in the FIR for causing dowry death of the daughter of the informant.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the fact that the petitioner is the father-in-law of the deceased and there is general and omnibus allegations against the petitioner and also considering the period of custody and submission of charge sheet, the petitioner is directed to be released on bail, on

No.18041 of 2025(2) dt.16-04-2025 3/3 furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-III, Gaya/concerned court, in connection with Magadh University P.S. Case No. 67 of 2020, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
