2.Learned counsel for the respondents invites attention to paragraph 4 of the counter affidavit which discloses that work order vide letter No. 60 dated 11.05.2012 has already awarded to Gramin Vikas Evam Samaj Kalyan Samiti of Village and Post Shahpur, District Bhojpur which has already commenced work. It is therefore, submitted that the writ petition has become infructuous and is not maintainable also on the ground of non-impleadment of necessary party

3. Be that as it may, in view of non-representation of the petitioner when the matter is called, the writ petition stands dismissed for non-prosecution.
