2. After institution of the present writ petition, the case was first taken up on 29.06.2012 on which date no one appeared on behalf of the petitioner. Again on 03.07.2012, no one appeared on behalf of the petitioner. The petitioner even not appeared on 04.07.2012 on which date this Court had directed the respondent nos. 1 and 2 to file their respective counter affidavit. Again vide order dated 06.08.2012, the matter was

Patna High Court CWJC No.5784 of 2012(14) dt.25-02-2023 2/2 adjourned for 10.10.2012 on which date the petitioner remained absent. Similarly on one occasion or other, no serious steps were taken by either parties and the matter was required to be adjourned on 29.11.2012, 07.01.2013, 28.01.2013, 27.02.2013, 13.03.2013 and finally on 03.05.2016, the writ petition was dismissed for non-prosecution of the petitioner. The writ petition was restored on 25.07.2022 and was running on the list and today when the matter has been taken up, no one appeared on behalf of either parties despite repeated calls.
