Mr.Murli Dhar ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-11-2019 Heard learned counsel for the petitioner, learned counsel for the opposite party no.2 and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Gopalpur P.S. Case No. 287 of 2018 registered under Sections 498(A), 323 and 504/34 of the Indian Penal Code and Sections 3/ 4 of the D.P. Act.

Learned counsel for the petitioner submits on the joint prayer of learned counsel for the petitioner and the opposite party no.2, the matter was referred to the Mediation Centre, Patna High Court, Patna, for settlement of dispute in between the petitioner and the opposite party no.2, who are husband and

Patna High Court CR. MISC. No.16817 of 2019(11) dt.20-11-2019 2/2 wife, but dispute could not be settled due to none appearance of opposite party no.2, which would appear from the Mediator's Report dated 19.11.2019.

On the other hand, learned counsel for the opposite party no. 2 submits that due to unavoidable circumstances, opposite party no. 2 could not appear before the Mediation Centre, Patna High Court, Patna.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Naugachia, Bhagalpur, in connection with Gopalopur P.S. Case No. 287 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
