The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

It is a case of recovery of about 30 bags of urea which is alleged to be of this petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner has not been apprehended at the spot and he has no concern with the seized article. Petitioner has got clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

No.29298 of 2021(4) dt.11-04-2022 2/2 In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Powakhali P.S. Case No. 41 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
