Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120(B) and 34 of the Indian Penal Code.

Four other persons fired at Akash, the brother of the informant in presence of the informant, as a result whereof, Akash died. The remaining four were outside at some distance and the petitioner was one of them. Submission is that on suspicion the petitioner has been named. Petitioner has got no criminal antecedent nor any overact is alleged against the petitioner. Petitioner is in custody since 04.03.2018. Investigation of the case is already complete against the petitioner.

No.47947 of 2018 (2) dt.20-08-2018 2/2 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Alamganj Police Station Case No.95 of 2018, G.R.No.876 of 2018 subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
