JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-05-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Araria P.S. Case No. 62 of 2020, registered under Section 30(a) and 38 of the Bihar Prohibition and Excise Act, 2016. The accusation is that in course of patrolling duty, the informant and other Police personnel received information about carrying of intoxicated medicines loading on Tata Indica vehicle towards Purnia, then informant and other Police personnel proceeded in that direction and when they reached at Ghothi Chowk one Tata India vehicle was seen near the canal at N.H. 57. On search, nine cartons, 160 bottles of intoxicated cough syrup recovered. On query, the driver of the vehicle disclosed his name Md. Istiyaq and he also disclosed

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-II-cum-Special Judge (Excise), Araria in connection with Araria P.S. Case No. 62 of 2020.
