2. The petitioner seeks bail in connection with Sarai P.S. Case No. 280 of 2024 registered for the offence punishable under Sections 303(2), 316, 318, 317, 338, 336 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, 300 bags of IFFCO APS fertilizer and 350 bags of IFFCO DAP fertilizer has been stolen from the truck which is alleged to have been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is in custody since 19.12.2024 for recovery of fertilizer and claims clean antecedent.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.Xth Vaishali at Hajipur//concerned Court in connection with Sarai P.S. Case No. 280 of 2024, subject to the condition that the bailors should be the close relative of the petitioner.

7. The petitioner will also mark attendance in Mahua Police Station, District-Vaishali on the first and third Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) P. Kumar U T
