On getting confidential information regarding assemblage of anti-social elements, a raid was conducted and during course thereof, other managed to escape while Mitthu Kumar, Atul Kumar (Petitioner) and Rohit Kumar were apprehended and on search, from the possession of Mitthu, a loaded country made pistol was recovered while from Rohit, one mobile and from the possession of petitioner, one Android Mobile set was seized. Furthermore, it has also been disclosed that during course of interrogation, Mitthu Kumar disclosed that they including others had assembled for committing murder of proprietor of Havells Shopkeeper as, he had not paid Rangdari and
Patna High Court Cr.Misc. No.59526 of 2017 (2) dt.12-12-2017 at his instance, one Ujjawal and Shubham were also taken into custody and as per their disclosure, country made loaded pistol was seized behind his house.
Petitioner has got no criminal antecedents as per para-3 of the petition and is under custody since 13.08.2017. Accordingly, petitioner, Atul Kumar is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Motihari, East Champaran in Chhatauni PS Case No. 203/2017.
