This is an appeal under Section 14 A (2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015 (hereinafter referred to as the "SC/ST Act") against the refusal of prayer for regular bail vide order dated 11.07.2018 passed by the learned 1st Additional Sessions Judge-cum-Special Judge, S.C./S.T. Act, Lakhisarai in S.C./S.T. Police Station Case No.29 of 2017 (arising out of S.C.S.T. No.294 of 2017) registered under Sections 341, 323, 504, 506, 379/34 of the Indian Penal Code as well as Section 3 (i) (r), (2) (Va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Patna High Court CR. APP (SJ) No.2773 of 2018 dt.13-08-2018 2/2 Considering the general and omnibus allegation of abuse and assault against the appellants, let the appellants, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with the aforesaid case, subject to the condition that the appellants shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the appellants.
Accordingly, the impugned order is set aside and this appeal stands allowed.
