The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) and 56(b) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 1800 litres of liquor was recovered from the Tata mini truck and it is stated that the driver Rohit Mandal as also this petitioner were taken into custody. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case under a misunderstanding. He has no concern either with the seized vehicle or the seized liquor. Coaccused Rohit Mandal has been enlarged on bail vide order dated 5.8.2021 passed in Cr.Misc. no.28165 of 2021. The petitioner is in custody since 16.2.2021

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case especially the petitioner not having any criminal antecedent and grant of bail to coaccused Rohit Mandal, the Court directs the petitioner to be enlarged on bail in connection with C 1 Case no. 36 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise) Purnea.
