The petitioner seeks regular bail in connection with Mithanpura P.S. Case No.95 of 2017 registered under Sections 302, 120(B)/34 of I.P.C. and Section 27 of the Arms Act. Accusation of the informant is that on 6.4.2017 at about 8.50 P.M. when her husband, Atul Shahi returned back from railway station to his residence two persons came on bullet motor cycle and opened fire on him causing injuries on his chest and neck and with the help of the people of vicinity, husband of the informant was rushed to the hospital for treatment where he was declared dead. Informant raised suspicion against Anjani Thakur because he earlier used to demand ransom who had taken Rs.7.30 lacs from her husband for selling his house.

No.33731 of 2018(3) dt.23-07-2018 2/2 Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. but in course of investigation it has come that this petitioner is one of the associates of Anjani Thakur, named F.I.R. accused and some of the co-accused also disclosed the name of this petitioner. He is in custody since 9.4.2017. The police has already submitted charge sheet against him. It is further submitted that many of the similarly situated accused persons have already been granted by a co-ordinate Bench of this Court, one of such order is dated 11.10.2017 passed in Criminal Miscellaneous No. 40392 of 2017.
Having considered the facts and the circumstances of the case, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 13th Additional & Session Judge, Muzaffarpur in connection with Mithunpura P.S.
