JUSTICE BIRENDRA KUMAR ORAL ORDER 06-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Siswan P.S. Case No.65 of 2016, a case under Sections 25(1-A),(1-B), 26/35 of the Arms Act and 3/4/5 Explosive Substance Act. According to F.I.R., firearm as well as Hand grenade was recovered from the possession of the petitioner. Submission of the learned counsel for the petitioner is that the petitioner is in custody since 30.05.2016. Though the petitioner has got criminal antecedent, however, the report of the Trial Judge reveals that the case is still pending for commitment to the Court of Sessions.

Considering the aforesaid facts and period already

Patna High Court Cr.Misc. No.56351 of 2017 (4) dt.06-02-2018 2/2 undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that both the bailors shall be resident of territorial jurisdiction of the court below, having immovable property in his name and the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
