Case No. 01 of 2018 dated 01.01.2018 instituted for the offences under Sections 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act, 1959.

It is alleged in the F.I.R. that the husband of the informant was fired at by the petitioner and his

Patna High Court CR. MISC. No.16541 of 2020(2) dt.02-06-2020 2/3 associates, namely, Bipin Mandal. The bullet fired at the husband of the informant crossed past him. The petitioner and another are also said to have fired in the air.

It has been submitted on behalf of the petitioner that an absolutely false case has been instituted against the petitioner with whom the husband of the informant had some enmity. The husband of the informant himself is a person for criminal proclivity. Nobody appears to have injured in the occurrence. The petitioner is in custody since 22.01.2019. The other cases in which the petitioner has been made accused earlier about which reference has been made in paragraph 3 of the bail petition, the petitioner is on bail in most of such cases.

Considering the afore-stated facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to
